These Terms & Conditions ("Terms") apply when you use the Skinnydip website or app and when you purchase products from us.
Please read them carefully before placing an order. By placing an order with us, you agree to these Terms.
Nothing in these Terms affects any rights you have under applicable consumer law.

Throughout these Terms, "Skinnydip", "we", "us" and "our" refer to Skinnydip Limited.
2. Who can shop with us
Our website and app are intended for customers purchasing products for personal use.
Products purchased through our consumer website or app must not be purchased for commercial resale without our prior agreement.
We reserve the right to refuse or cancel orders where we reasonably believe products are being purchased for resale, where unusually large quantities are ordered or where ordering activity appears inconsistent with normal consumer use.
3. Placing an order
When you place an order through our website or app, you are making an offer to purchase the products in your basket.
After placing your order, you will normally receive an order acknowledgement. This confirms that we have received your order, but it does not mean that we have accepted it.
Your order is accepted and a contract between you and Skinnydip is formed when we send you confirmation that your order has been dispatched.
Payment may be authorised or taken before your order is dispatched. This does not mean that your order has been accepted.
If we are unable to accept your order after payment has been taken, we will refund the relevant amount.
4. When we may cancel an order
Sometimes we may need to reject or cancel an order before dispatch.
This may happen where:

a product is unexpectedly out of stock;

we have oversold a product;
-
payment cannot be authorised;
-
we suspect fraud or unauthorised payment activity;
-
there is an obvious error in the product description or price;
-
we cannot deliver to the address provided;
-
an order breaches purchase limits or promotional conditions;
-
we reasonably believe products are being purchased for commercial resale; or
-
there is another legitimate reason that prevents us from fulfilling the order.
Where possible, we will let you know if this happens.
If we cancel an order after taking payment, we will refund the amount paid for the cancelled products.
5. Products
We do our best to display and describe our products accurately.
However, colours may appear slightly different depending on your device, screen settings and lighting.
Product packaging, details and specifications may occasionally change.
Images are provided for illustrative purposes and there may be minor differences between the product shown and the product you receive.
Nothing in this section affects your rights if a product is faulty, not as described or otherwise does not meet your statutory rights.
6. Prices
Prices are displayed on our website or app before you place your order.
The currency displayed may depend on your location.
Where applicable, prices include VAT or other relevant sales taxes unless otherwise stated.
Delivery charges and any other applicable costs will be shown during checkout before you confirm your purchase.
7. Pricing errors
We try to ensure that all prices are correct, but mistakes can occasionally happen.
If we discover an obvious pricing error before accepting your order, we may contact you and give you the option to purchase the product at the correct price or cancel the affected item.
Where the pricing error is obvious and could reasonably have been recognised as an error, we may cancel the affected order before dispatch.
If payment has already been taken, we will refund the amount paid for any cancelled item.
8. Payment
We accept the payment methods displayed at checkout.
Depending on your location and device, these may include payment methods provided by:

Klarna;

Revolut;

Apple Pay;

Google Pay; and
-
Shop Pay.
Payment options may change from time to time.
Some payment providers offer their own payment or credit products. Where you choose one of these services, additional terms between you and that payment provider may apply.
We are not responsible for the terms of any separate credit or payment agreement you enter into with a third-party payment provider.
9. Delivery
Available delivery options, estimated delivery times and charges will be shown on our website and/or at checkout.
Delivery times are estimates rather than guaranteed delivery dates, unless we expressly tell you otherwise.
We will take reasonable steps to deliver your order within the estimated timeframe, but delays can sometimes occur due to circumstances outside our reasonable control.
If there is a significant delay, please contact our Customer Service team.
Nothing in this section limits your statutory rights relating to delivery.
10. Lost parcels
If your order has not arrived within the estimated delivery timeframe, please contact our Customer Service team.
In most cases, we ask customers to allow up to 14 working days for delayed parcels before an order is treated as potentially lost.
We may need to investigate the delivery with the relevant courier before issuing a replacement or refund.
This does not affect any rights you may have under applicable consumer law.
11. International orders
We ship to a range of international destinations.
Available countries and delivery options will be shown at checkout.
We aim to cover applicable duties and taxes where this is supported by the destination and delivery service. However, there may be circumstances or destinations where local import duties, taxes, customs charges or handling fees are not included in the amount you pay to Skinnydip.
Where these charges are not included, you may be responsible for paying them to the relevant authority or carrier.
Customs procedures may also cause delays that are outside our reasonable control.
Please check the information provided at checkout for your destination before placing your order.
12. Returns
We hope you love your Skinnydip order, but if you change your mind, you can return eligible products within 14 days of receiving your order, subject to our Returns Policy and your statutory rights.
Products should be returned in their original condition and, where appropriate, with original packaging, labels and hygiene seals intact.
Unless the product is faulty, incorrect or otherwise covered by your statutory rights, you are responsible for the cost of returning it to us.
International customers are responsible for their return postage costs unless otherwise stated or the product is faulty or incorrect.

13. Products that cannot normally be returned
For hygiene, safety or customisation reasons, certain products may not be eligible for change-of-mind returns.
This may include:

beauty and cosmetic products where they have been opened, used or their hygiene seal has been broken; and
-
personalised or made-to-order products.
These exclusions do not apply where a product is faulty, not as described or where you otherwise have a statutory right to a remedy.
14. Faulty or incorrect products
If you receive a product that is faulty, damaged, incorrect or not as described, please contact our Customer Service team.
We may ask you to provide photographs or other information so that we can investigate the issue.
Depending on the circumstances and your statutory rights, we may offer an appropriate repair, replacement, refund or other remedy.
Nothing in these Terms limits your statutory rights in relation to faulty or misdescribed goods.
15. Refunds
Approved refunds will normally be returned to your original payment method.
The time it takes for the refund to appear in your account may depend on your bank or payment provider.
Where an entire eligible order is cancelled under applicable consumer cancellation rights, any standard outbound delivery charge will be refunded where required by law. Additional amounts paid for premium or expedited delivery may not be refundable beyond the cost of our standard delivery option.
16. Promotions and discount codes
From time to time, we offer discount codes, promotional offers, bundles and other promotions.
Unless the specific promotion says otherwise:
-
discount codes apply only to eligible full-price products;
-
discount codes cannot be used on sale products;
-
only one discount code may be used per order;
-
discount codes cannot be combined or stacked;
-
discount codes cannot be applied retrospectively;
-
gift cards cannot be purchased using promotional discount codes;
-
promotions have no cash alternative;
-
promotions are subject to availability; and
-
additional exclusions may apply.
Individual promotions may have their own terms, qualifying products, minimum spends, maximum discounts, dates or exclusions. Where this is the case, those specific promotional terms will apply in addition to these Terms.
We may withdraw or amend a promotion where reasonably necessary, provided this does not affect orders that we have already accepted under that promotion.
17. 2 for £45 phone case offer
Where advertised, eligible full-price phone cases may be purchased as part of our automatic 2 for £45 offer.
The offer applies only to products specifically identified as eligible.
The discount will be applied automatically when the qualifying products are added to your basket.
The offer:
-
applies to eligible full-price phone cases only;
-
does not apply to sale products unless expressly stated;
-
cannot be combined with another discount code unless expressly stated; and
-
is subject to availability.
Returning part of the offer
If you return one item from a 2 for £45 purchase and keep the other, the item you keep will revert to its normal full price.
Your refund will therefore be calculated as the difference between the £45 promotional price paid and the full price of the item you keep.
For example, if you purchase a £30 case and a £25 case for £45 and return the £25 case, the £30 case you keep reverts to its £30 full price and your refund will be £15.
This does not affect your statutory rights if either product is faulty, incorrect or not as described.
18. Student discount
Eligible students may receive a Skinnydip student discount.
Our standard student discount is currently 20% off eligible full-price products, although the discount level may occasionally change or additional terms may apply.
Eligibility may be verified directly by Skinnydip or through an approved student verification partner, including UNiDAYS or Student Beans.
Unless otherwise stated:
-
student discount applies to eligible full-price products only;
-
it cannot be applied to sale products;
-
it cannot be combined with another promotional code;
-
certain products, brands or collaborations may be excluded; and
-
the discount is for the verified student's personal use.
We reserve the right to refuse or withdraw student discounts where we reasonably believe they are being misused.
19. Gift cards
Skinnydip gift cards are available subject to the terms shown when purchasing them.
Unless otherwise stated:
-
Skinnydip gift cards expire 12 months from the date of purchase;
-
gift cards are non-refundable, except where required by law;
-
promotional discount codes cannot be used to purchase gift cards;
-
gift cards cannot be exchanged for cash;
-
gift cards should be treated like cash and kept secure; and
-
gift cards may only be used through the Skinnydip sales channels specified when they are purchased.
If the value of an order exceeds the available gift card balance, the remaining amount must be paid using another accepted payment method.
Your statutory rights are not affected.
20. Our app
These Terms also apply to purchases made through the Skinnydip app.
Additional terms imposed by the platform through which you downloaded the app, such as Apple's App Store or Google Play, may also apply to your use of the app itself.
We may update, change or discontinue app features from time to time.
21. Customer accounts
You may have the option to create a Skinnydip customer account.
You are responsible for keeping your login information secure and should not share your password or other account credentials with anyone else.
Please contact us if you believe your account has been accessed without your permission.
We may suspend or close accounts where we reasonably believe there has been fraud, misuse or a breach of these Terms.
22. Reviews, comments and user content
We may allow customers to submit reviews, comments, photographs or other content.
You remain the owner of content you create.
By submitting content directly to Skinnydip for publication or use, you confirm that:

you have the right to share it;
-
it does not infringe another person's intellectual property or privacy rights;
-
it is not unlawful, abusive, discriminatory, defamatory or misleading; and
-
it does not contain malicious software or other harmful material.
Where you submit content to us specifically for publication, you give us permission to display, reproduce and use that content for the purpose for which it was submitted.
Separate permissions may apply where we ask to use customer content in wider marketing or advertising.
We may moderate or remove content where we reasonably consider it inappropriate, unlawful, misleading or in breach of these Terms.

23. Intellectual property
Unless otherwise stated, the content available through Skinnydip's website and app belongs to Skinnydip Limited or is used by us under licence.
This includes, where applicable:
-
designs;
-
branding;
-
logos;
-
graphics;
-
photographs;
-
videos;
-
product imagery;
-
text;
-
website design; and
-
other creative material.
You may use our website and app for personal, non-commercial purposes.
You must not reproduce, distribute, sell, commercially exploit or otherwise use our intellectual property without permission, except where permitted by law.
Third-party characters, artwork, logos and other intellectual property appearing on licensed Skinnydip products remain the property of their respective owners and licensors.
24. Acceptable use
You must not misuse our website or app.
In particular, you must not knowingly:
-
introduce viruses, malware or harmful technology;
-
attempt to gain unauthorised access to our systems;
-
interfere with the operation or security of our website or app;
-
scrape or extract information for unauthorised commercial purposes;
-
use automated systems to place excessive or abusive orders;
-
commit or attempt fraud; or
-
use our services for unlawful purposes.
We may restrict access where reasonably necessary to protect Skinnydip, our systems or our customers.
25. Third-party websites and services
Our website or app may contain links to websites, platforms or services operated by third parties.
These third parties operate independently from Skinnydip and may have their own terms and privacy policies.
We are not responsible for third-party websites or services that we do not operate or control.
26. Our responsibility to you
We are responsible for losses that you suffer where they are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that are not foreseeable.
Because our website, app and products are intended for consumers, we are not responsible for business losses such as loss of profits, revenue, business opportunity or business interruption arising from consumer purchases.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
-
death or personal injury caused by negligence;
-
fraud or fraudulent misrepresentation; or
-
your statutory consumer rights.
27. Events outside our reasonable control
Sometimes circumstances outside our reasonable control may affect our ability to provide our services or fulfil an order.
These could include transport disruption, severe weather, strikes, supply chain disruption, customs delays, telecommunications failures or other events we could not reasonably prevent.
Where this happens, we will take reasonable steps to minimise the effect on you.
Your statutory rights are not affected.
28. Changes to these Terms
We may update these Terms from time to time to reflect changes to our business, products, services or applicable law.
The Terms that apply to your purchase will generally be those in force when you place your order.
We will update the "Last updated" date at the top of this page whenever these Terms are changed.
29. If part of these Terms is invalid
If a court or relevant authority decides that any part of these Terms is unlawful or unenforceable, the remaining sections will continue to apply.
30. Delayed enforcement
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
31. Transferring our rights
We may transfer our rights and obligations under these Terms to another organisation, for example as part of a sale, reorganisation or transfer of our business.
Where this affects your rights, we will ensure that your rights under the contract are not reduced.
You may only transfer your rights under these Terms where the law permits or where we agree.
32. Governing law
These Terms are governed by the laws of England and Wales.
If you live in another part of the UK, you may also be entitled to bring proceedings in your local courts.
If you live outside the UK, you may also have mandatory consumer protections under the laws of the country where you live. Nothing in these Terms is intended to remove rights that cannot legally be excluded.
